| Abstract(J) | 自動運転システムを含む自律システムによって構成される、いわゆるSociety 5.0は、巨大、複雑かつ動態的な性質を有している。しかし、現行の法制度、特に刑事法は、この新たな社会において十分に機能することができないかもしれない。というのも、現行刑事法が前提としていた状況と未来社会の状況との間に大きなギャップが存在するために、イノベーションを促進することも、リスクを適切にマネジメントすることも難しいからである。近い将来に生じうる困難を避けるために、著者は刑事司法制度にもいわゆるアジャイルガバナンスの方法論を取り入れ、官民協働で変化し続ける不確実な状況にシステムを適合させていくべきであると主張する。 Translation |
| Abstract(E) | In the emerging society, so called “Society 5.0”, autonomous systems, including autonomous vehicle system, become parts of a huge, complex and dynamic social system. However the current legal regime, especially criminal law system, may not work well in the future society due to the gap between its premise and the social reality. This gap may result in the undesirable situation where innovation is chilled but risk is not appropriatley managed. In order to avoid a barren future, the author argues that criminal justice system should incorporate the methodology of“ Agile Governance” that allows stakeholders to quickly modify the system to adopt the chaning and uncertain situation. |
